Cancellation Policy

TERMS You acknowledge and agree to the following: Shared & Private Charters: ~ A non-refundable 25% deposit confirms booking. ~ Balance is due 150 days before the first tour date, also non-refundable. ~ Timely payments are Guest's responsibility. ~ Bookings are confirmed only when payment is receipted. Group Bookings (3+ days): ~ A non-refundable 25% deposit (payment #1) confirms booking. ~ Additional non-refundable payments are due: January 1 (payment #2, 25%) March 1 (payment #3, 25%) May 1 (payment #4, final balance). ~ Timely payments are the Group Leader or Booking Agent’s responsibility. ~ Bookings are confirmed only when payment is receipted.​ Cancellation Policy ~ Cancellations >150 days before check-in: loss of deposit. ~ Cancellations >150 days / no-shows: 100% of booking cost forfeited. ~ Group booking payments are non-refundable at each date threshold. ~ Dates are non-transferable. ~ Applies in all circumstances (health, weather, airline issues, pandemics, natural disasters, border closures, etc.). ~ Bookings may be transferable to another person (client-sourced) minus 25% deposit. ~ All cancellations must be submitted in writing via email. ~ Credit card and bank fees apply. Strongly recommended: travel cancellation and medical insurance with evacuation and pandemic coverage. Payment Methods ~ Includes 15% Consumption Tax. ~ In Tongan Pa'anga (TOP) via Visa, MC, AMEX (4.167% bank fee) or bank transfer ($20 bank fee.) ~ Bank Transfer: Reference name. Bank uses SWIFT system. ~ Bank fees and currency exchange costs are extra.​ Safety Requirements ~ All guests must be able to swim and independently climb aboard the boat using a ladder. ~ Guests must follow all guide and skipper instructions. ~ For safety and regulatory compliance, SCUBA diving, duck-diving, and free-diving is prohibited. ~ The skipper may remove non-compliant guests or cancel activities to protect safety of guests & whales. No guarantee of whale encounters or successful swims is possible, due to the seasonal variability of wildlife. Liability & Hold Harmless ~ Passengers must sign a liability waiver before boarding. ~ South Pacific Sea Adventures, Ltd. , aka Explore Vava’u, and associated entities, owners, employees, shareholders, and associates, are not liable for disruptions caused by: 3rd-party transportation issues, Pandemics, Natural disasters, States of emergency, Quarantine requirements. Guests release and hold harmless all related parties from any liability.
