Cancellation Policy

By confirming the booking, you accept these Terms: Shared & Private Charter Payments: Non-refundable 25% deposit confirms booking; balance due 150 days before first tour date, also non-refundable. Timely payments are Guest’s responsibility. Non-compliance results in cancellation without refund. Bookings are not tentatively held and are confirmed only upon receipted payment. Private Charter Group Booking Payments (5+ days): Non-refundable 25% deposit (payment #1) confirms booking. Non-refundable 25% installments due January 1 (#2) and March 1 (#3). Final non-refundable balance due May 1 (#4). Timely payments are Group Leader/Booking Agent’s responsibility. Non-compliance results in cancellation without refund. Bookings are not tentatively held and are confirmed only upon receipted payment. Cancellation Policy: Shared/Private Charters: 150+ days before check-in: Forfeit 25% deposit (non-transferable). 150 days or less/no-shows: Forfeit 100% of invoice. Group Bookings: Payments forfeit at each date threshold; dates non-transferable. Applies to all situations (health, weather, airline issues, pandemics, natural disasters, border closures, etc.). Travel/medical insurance with pandemic coverage strongly recommended. Bookings transferable to another person (client-sourced) minus 25% deposit. Cancellations must be in writing via email; credit card/bank fees apply. Payment Methods: Invoices include 15% Consumption Tax. Payments in Tongan Pa’anga (TOP) via Visa, MC, AMEX or bank wire transfer. Include name and invoice number. Bank fees not included; currency exchanges use local BSP bank rate plus fees. Fuel Surcharge: If fuel prices exceed TOP 5.01/liter (currently TOP 3.40–3.70), additional costs shared among passengers, due before boarding. Whale Watching: No refunds for unsuccessful whale swims due to migratory nature. We follow Ministry conservation regulations. Guests must swim, climb boat ladder independently, and follow guide’s instructions. Sinking below 3m and duck diving prohibited. Skipper/Guide may remove non-compliant guests or cancel swims for safety. Hold Harmless & Release of Liability: Confirming the booking releases South Pacific Sea Adventures, Ltd., Flying Coconut, Ltd., and Fetoko Adventures, Ltd. from all liability and agrees they are not liable for third-party transportation cancellations, pandemics, natural disasters, border closures, or quarantine requirements. Confirming signifies agreement to all Terms.
